Fueled Racing Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the website https://fueledracing.com/ (the “Site”), operated by Fueled Racing (“we,” “us,” or “our”), a manufacturer of high-quality aftermarket LS and LSX swap parts based in Mesa, Arizona. By accessing or using the Site, placing an order, or engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. You agree to use the Site only for lawful purposes and in accordance with these Terms. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal and non-commercial purposes, subject to these Terms.

You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

2. Product Information and Orders

•  Product Descriptions: We strive to provide accurate descriptions, images, and pricing. However, we do not warrant that all information is error-free. Colors, specifications, and availability may vary. We reserve the right to correct errors and update information without notice.

•  Pricing and Taxes: All prices are in U.S. Dollars and subject to change. Sales tax will be collected where required by law. You are responsible for any additional duties, taxes, or fees for international shipments.

•  Order Acceptance: Your order is an offer to purchase. We reserve the right to accept, reject, or limit orders for any reason, including errors, suspected fraud, or product unavailability. We will notify you if we cancel an order.

3. Payment

Payments are processed securely through third-party providers (e.g., Stripe, PayPal). You agree to provide accurate payment information and authorize us to charge the applicable amount. We are not responsible for any issues with third-party payment processors.

4. Shipping and Delivery

Shipping times are estimates only and not guaranteed. Risk of loss passes to you upon delivery to the carrier. Title passes upon full payment. We are not liable for delays caused by carriers, customs, or events beyond our control. International shipments may incur additional fees or delays.

5. Returns, Refunds, and Warranty

•  Returns: Contact us at fueledracingusa@gmail.com for a Return Merchandise Authorization (RMA) before returning any item. Returns must be in original, unused condition with all packaging and accessories within 30 days of receipt (custom items and special-order parts are generally non-returnable unless defective).

•  Refunds: Approved returns will be refunded to the original payment method, minus any shipping costs or restocking fees (typically 25% for non-defective returns). Refunds are processed within 30 business days after receipt and inspection.

•  Warranty: Our products carry a limited warranty against manufacturing defects for 12 months from the date of purchase. This warranty does not cover misuse or improper installation. Contact us for warranty claims with proof of purchase.

•  Damaged or Defective Items: Inspect shipments immediately. Report damage within 48 hours with photos.

6. Intellectual Property

All content on the Site, including logos, images, text, designs, and product names, is owned by Fueled Racing or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

7. Prohibited Conduct

You agree not to:

•  Use the Site for any illegal or unauthorized purpose.

•  Violate any laws, including those related to intellectual property or export controls.

•  Interfere with the Site’s security or functionality.

•  Engage in scraping, data mining, or automated access without permission.

•  Submit false or misleading information.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUELED RACING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Products are for off-road/racing use and may void vehicle warranties. Installation and use are at your own risk. Always follow professional installation and safety guidelines.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of products, or infringement of third-party rights.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

11. Changes to Terms

We may update these Terms periodically. We will post the revised version with a new effective date. Continued use of the Site after changes constitutes acceptance.

12. Termination

We may terminate or suspend your access to the Site at any time, with or without cause.

13. Miscellaneous

These Terms constitute the entire agreement between you and us. If any provision is held invalid, the remainder remains enforceable. No waiver of any breach constitutes a waiver of any other breach.
